1. Introduction

This Consumer Health Data Privacy Policy explains how Milasha LLC (“Company”, “we”, “us”, “our”), operating under the brand name “Lived Fertility”, collects, uses, shares, and protects information that may constitute “consumer health data” under applicable United States state consumer health privacy laws.

This policy supplements our general Privacy Policy and applies to individuals whose consumer health data is protected by applicable United States state law. It does not replace our general Privacy Policy, which applies more broadly to personal information processed by the Company.

Lived Fertility provides private, experience-based guidance relating to fertility, reproductive decision-making, pregnancy, and early motherhood. Lived Fertility does not provide medical or clinical services. However, because of the nature of the services, information that an individual chooses to provide may include or reveal information that is classified as consumer health data under certain United States state privacy laws.

2. Consumer health data we may collect

Depending on the information you choose to provide when requesting or using our services, consumer health data may include information relating to:

  • fertility or reproductive health;

  • fertility treatment considerations;

  • IVF or other assisted reproductive treatment;

  • pregnancy or pregnancy considerations;

  • donor conception;

  • emotional or personal circumstances where considered health-related information under applicable law;

  • medical conditions, medical history, treatment, procedures, or other health information that you voluntarily choose to disclose; and

  • other information you voluntarily provide that may reveal or permit an inference concerning your health or reproductive circumstances.

We do not require you to provide full medical records in order to request Lived Fertility services.

3. Sources of consumer health data

We may collect consumer health data:

  • directly from you when you complete an intake form;

  • directly from you during a session or other service;

  • from communications you send to us, including email; and

  • from information you otherwise voluntarily provide in connection with your request for or use of our services.

We do not purchase consumer health data from data brokers.

4. Why we collect and use consumer health data

We may collect and use consumer health data where reasonably necessary to:

  • review your intake submission;

  • understand the guidance you are seeking;

  • determine whether Lived Fertility services are appropriate for your request;

  • accept or decline a service request;

  • provide the experience-based guidance or services you request;

  • communicate with you in connection with those services;

  • administer our relationship with you;

  • maintain the security and integrity of our services;

  • establish, exercise, or defend legal claims where necessary.

We do not use consumer health data for targeted advertising.

We do not sell consumer health data.

We will not collect or use additional categories of consumer health data, or use consumer health data for materially different purposes, where applicable law requires additional notice or consent without first providing that notice and obtaining the required consent.

5. Sharing of consumer health data

We may share the categories of consumer health data described in Section 2 where reasonably necessary to operate and provide the services you request. The particular information shared will depend on the service involved and will be limited to information reasonably necessary for the relevant purpose.

Depending on how you interact with us, consumer health data may be shared with the following categories of service providers:

  • Squarespace, for website functionality, forms, and related services;

  • Google or other providers used for email, communications, or video conferencing;

  • technology, hosting, security, or administrative service providers; and

  • professional advisers where reasonably necessary.

We do not currently share consumer health data with any affiliates.

We do not share consumer health data with third parties for their own targeted advertising purposes.

We do not sell consumer health data.

We do not knowingly permit third parties to collect consumer health data over time and across different websites or online services when you use our website for targeted advertising purposes.

6. Consumer health data and business transfers

Consumer health data may be transferred as part of, or in connection with, a merger, acquisition, reorganization, financing, sale of assets, or similar business transaction, subject to applicable law and any rights or protections applicable to the information.

Such a transfer does not authorize the recipient to use consumer health data in a manner inconsistent with applicable law.

If an intake request is not accepted, or does not proceed to services, consumer health data associated with the intake will generally be retained for up to 90 days after the decision or last interaction, unless a longer period is reasonably necessary or required by applicable law.

Certain information may be retained for longer where reasonably necessary to comply with legal obligations, resolve disputes, prevent fraud or misuse, or establish, exercise, or defend legal claims.

When information is no longer reasonably required, it will be deleted or otherwise disposed of in accordance with our practices and applicable law.
